The Tripoli Court of Appeals have deferred the sentencing of former Jamahiriya officials until August 23.

It is not clear whether this latest decision applies to all detainees or only a select few.  No mention was made of the court’s intentions regarding the sentencing of Saif Gaddafi.

The National Human Rights Commission in Libya have demanded an immediate halt to all trials of Jamahiriya officials because the prisoners are being detained and tried by militias outside state jurisdiction, with complete disregard for principles of justice and the rule of law.

All  detainees have been subjected to torture, inhumane conditions and denied access to legal counsel. Further,  militia “investigations” carried out allegedly to gather evidence of crimes, were unlawful – many false confessions having been extracted through torture.

Where detainees had defense counsel, their lawyers were prevented from attending court sessions, being denied entry visas or receiving threats against their lives.

Last week, General Mustafa Kharroubi died in Tripoli’s Al Habda prison under suspicious  circumstances.  Human rights organizations are demanding a full investigation into the cause of his death.  He had been held without charges for three years.  Throughout his imprisonment he was kept in solitary confinement.

It is worth drawing attention to a report from Human Rights Watch [Libya : Widespread Torture in Detention Facilities Within HoR Jurisdiction] that provides irrefutable evidence that torture is taking place in detention facilities across the country, including those under the so-called “internationally recognized” government’s control.

Previously, when confronted with  atrocities committed against detainees,  the HoR condemned the actions, while denying they had any ability to end the abuses since these crimes were being committed in territory outside state jurisdiction.

Based on the facts presented in the Human Rights Watch report,  it is evident that they would not act to end abuses even if they had the power to do so, since they allow the same egregious violations to continue with impunity within their own territory.
