PRESS RELEASE
The Government of Reconciliation and National Unity informs the people of Nicaragua and the international community that today it submitted its Memorial in the case before the International Court of Justice against the Federal Republic of Germany concerning the Alleged Breaches of Certain International Obligations in respect of the Occupied Palestinian Territory. Nicaragua's written pleadings were submitted in a timely manner, as required by the Court.
In its Memorial, Nicaragua demonstrates that Germany's violations date back decades and points out that they include failure to fulfill its obligation to ensure respect for international humanitarian law, failure to respect and promote the realization of the Palestinian people's right to self-determination, including the obligation not to do anything to help or assist Israel in maintaining the situation created by its illegal presence and its regime of racial discrimination, segregation, and apartheid in the Occupied Palestinian Territory, and failure to prevent, punish, and not be complicit in genocide.
Nicaragua has detailed before the Court the political, economic, and military support, among other forms, that Germany has provided to Israel and that has facilitated violations of peremptory norms of international law despite the conclusions of the Court in its Advisory Opinions of 2004 and 2024, which detail the consequences and obligations of third States not to aid or assist Israel in its illegal conduct.
In view of the above, Nicaragua has requested that Germany cease its unlawful conduct, including the export of military equipment, the distinction in its commercial, cultural, and academic activities between the territory of Israel and the occupied Palestinian territory, the non-repetition of such conduct, and reparation for the Palestinian victims, among other things.
Nicaragua once again calls on all countries to take concrete measures to stop genocide, apartheid, and war crimes, and calls on them to comply with the relevant norms of international law, including the duty not to recognize as legitimate the situation created by the illegal acts committed by Israel, as confirmed by the International Court of Justice in its Advisory Opinions of 2004 and 2024. Similarly, it calls on them to cease all military support in order to avoid the risk that such weapons will be used to violate international law, in accordance with the Ordinance of April 30, 2024.
Finally, Nicaragua wishes to thank all those who worked on the preparation of this Memorial, which has been submitted in compliance with Nicaragua's international obligations to take all necessary measures to stop violations of the most fundamental norms of international law against the Palestinian people.
The Government of Reconciliation and National Unity reaffirms its firm commitment to the rule of law at the international level and to the peaceful settlement of disputes between States.
