Articles of Nicaragua's Criminal Code relating to Treason

The following articles of the Nicaragua's Criminal Code, Law 641,  deal with crimes of Treason and crimes that Compromise Peace. The Penal Code was approved in the National Assembly in 2007 when the opposition parties to President Ortega's government had a majority in the legislature.

TITLE XVII

CRIMES AGAINST THE SECURITY OF THE STATE

CHAPTER I

ACTS OF TREASON

Art. 409 Treason
Any Nicaraguan who in an international armed conflict takes up arms against Nicaragua or joins its enemies by giving them aid or collaboration or facilitates the advance or progress of the enemy forces or hinders the defense of the State, shall be punished with imprisonment of ten to fifteen years and absolute disqualification from holding public office, employment or position for the same period.

The same penalties shall be imposed on anyone who induces a foreign State to declare war on Nicaragua or who conspires with it for the same purpose.

If the perpetrator is a public authority, official or employee, the above penalties shall be increased by one third.

Article 410 Impairment of national integrity
Whoever carries out acts tending to undermine or divide the territorial integrity of Nicaragua, to submit it in whole or in part to foreign domination, or to affect its nature as a sovereign and independent State, shall be punished with ten to fifteen years' imprisonment and absolute disqualification for the same period from holding public office, employment or position, except as provided in the Political Constitution of the Republic of Nicaragua.

Article 411 Treason committed by foreigners
The preceding provisions are applicable to foreigners residing in Nicaraguan territory, except as provided by treaties ratified by Nicaragua or by international law concerning diplomatic officials and nationals of countries in conflict.

Art. 412 Provocation, proposition and conspiracy
Provocation, proposition and conspiracy to commit any of the acts provided for in this Chapter shall be punishable by a penalty whose maximum limit shall be the lower limit of the respective penalty and whose minimum limit shall be half of the latter.

CHAPTER II

CRIMES THAT JEOPARDIZE THE PEACE

Art. 413 Hostile acts
Whoever by illegal acts or acts not duly authorized by the national government, in accordance with national legislation, provokes or puts in imminent danger a declaration of war against Nicaragua, or exposes its inhabitants to experience vexations or reprisals in their persons or property, or endangers the peaceful relations of the Nicaraguan government with a foreign government, shall be punished with two to six years imprisonment.
